QUESTION : Does âAt-Will Employmentâ apply to our facility and how do we follow it correctly.
ANSWER: Oklahoma is an âAt-Will Employment Stateâ. Oklahoma does not have legal requirement on employers where employee rights for a break, termination, etc⦠are concerned. They err on the side of your employment handbook. At-Will Employment will give either party the right to end an employment without prior corrective action or notice during the probation period stated in your handbook. After that period, the employer would need to follow the handbook to the letter.
Example: If your handbook does not state specific breaks including lunch, the state of Oklahoma does not require any breaks. Including Lunch. It is always good to review your handbook periodically to make sure it still reflects your facility and needs.
